PROCESS FOR RESTRAINING ORDERS

AND ORDERS OF PROTECTION

 

Litigants may obtain restraining orders and orders of protection using processes that were in effect prior to the COVID-19 pandemic.  That is, temporary orders may be obtained on the ex parte dockets and then will be scheduled for hearings on the Domestic and DVP Dockets.

STATE STIMULUS CHECKS
 
It is the policy of the Benton Franklin Counties Superior Court that if the parties in a pending domestic matter are unable to agree regarding the division of any Stimulus funds received by either party, in any form, from the United States Treasury, they shall, within 5 business days of receipt, deposit the funds in the trust accounts of their respective counsel.  If a party is not represented, they shall either retain the amount in the account into which it was deposited and account for the same, or shall retain any check they receive, and shall not negotiate (cash) or attempt to negotiate (attempt to cash) any check until directed by the Court.

Click below to view the Washington State Supreme Court Amended Emergency Order No. 25700-B-607 that clarifies the scope of permissible activity until April 24, 2020.  This order was entered on March 20, 2020.  The email that acompanied the amended order indicates that it supersedes the order of March 18, 2020.

Click below to view the Washington State Supreme Court's Third Revised Order Regarding Court Operations No. 25700-B-625 that clarifies the scope of permissible activity until July 6, 2020.  This order was entered on May 28, 2020.  The order supersedes the Supreme Court's March 18, 2020 order (as corrected March 19, 2020), its March 20, 2020 amended order, and its Extended and Revised Orders of April 13, 2020 and April 29, 2020.
