Benton and Franklin Counties Superior Court has developed guidelines designed to efficiently and fairly process adult familiy cases. Click on the link below to view the guidelines.
In both counties, lengthly proceedings, such as 3.5, 3.6, Knapstad motions and motions to terminate or modify no contact orders will no longer be held on the regular Criminal Dockets. Rather, they will be heard Friday mornings in Benton County and Thursday mornings in Franklin County on what is called the "3.5/3.6 Docket". Under some circumstances, it may be apropriate for the Court to consider a sentence that does not require confinement in jail for the entire period of confinement ordered. There are alternatives to complete confinement which fall into three categories: Work Crew, Work Release, and Electronic Home Monitoring. Ultimately, the Court determines which, if any of these alternatives are appropriate. But, Benton County Sheriff has adopted policies concerning eleigibility, costs and procedures.
