In both counties, lengthly proceedings, such as 3.5, 3.6, Knapstad motions and motions to terminate or modify no contact orders will no longer be held on the regular Criminal Dockets. Rather, they will be heard Friday mornings in Benton County and Thursday mornings in Franklin County on what is called the "3.5/3.6 Docket". Please click HERE to read the details of the 3.5/3.6 Docket. Please look below for the form Note for 3.5/3.6 Docket.
Under some circumstances, it may be apropriate for the Court to consider a sentence that does not require confinement in jail for the entire period of confinement ordered. There are alternatives to complete confinement which fall into three categories: Work Crew, Work Release, and Electronic Home Monitoring. Ultimately, the Court determines which, if any of these alternatives are appropriate. But, Benton County Sheriff has adopted policies concerning eleigibility, costs and procedures. Superior Court Statement On Appearances In Court In Light of Governor's Order to Mask
The Superior Court is withdrawing this prior general presumption of personal appearance at hearings to address concerns regarding the Delta variant of Covid-19. The Court’s order can be found HERE. In light of the Governor’s Order that all individuals who enter buildings wear masks, regardless of vaccination status, it is appropriate for individuals who can appear remotely to do so if they wish. The Courtrooms remain open to the public with capacity limits and the requirement of masking for all. In some criminal matters it is necessary to require the presence the Defendant or Respondent.. Those who wish the opportunity to appear remotely via WebEx must ensure that their connection is sufficient to be heard and/or seen, and that their appearance and behavior during a hearing is appropriate for the Courtroom.
